Terms of Service

Welcome to Gotchu. These Terms govern your use of Gotchu at gotchu.media and its studio pages. By creating an account or using the service, you agree to these Terms.

1. What Gotchu is

Gotchu is a platform that lets independent event media — photographers, videographers, and drone/FPV pilots ("Media") — deliver and sell their footage to the drivers, fans, and attendees at motorsport and action-sports events ("Buyers"). Gotchu provides the tools; the Media run their own studios, set their own prices, and deal directly with their Buyers.

2. Accounts

• Provide accurate information and keep your login secure.
• You're responsible for activity under your account.
• You must be old enough to form a binding contract where you live.

3. Payments — footage

• Media set their own prices. By default, Buyers pay the Media directly through the Media's own payment handles (e.g. PayPal, Venmo, Cash App, Zelle), and Gotchu does not process, hold, or take a cut of those payments.
• Gotchu may offer an optional in-app checkout that a Media can choose to use. Where a Media uses it, payments are processed through Gotchu's third-party payment processor, Gotchu may deduct a per-transaction platform fee, and the remainder is paid out to the Media.
• Gotchu is not the seller or merchant of record for footage. Any purchase, refund, or dispute over footage is between the Buyer and the Media.

4. Payments — Gotchu subscription

• Media may use Gotchu free until they start making sales. After that, continued use requires a paid subscription (currently $20/month).
• We may pause ("freeze") a studio's public page and store if its subscription isn't active. A freeze doesn't delete your content or data.
• Subscription billing, when enabled, is handled by our payment processor and is separate from footage sales.

5. Your content

• Media keep all rights to the footage and other content they upload. You grant Gotchu a limited license to host, process, watermark, and display it as needed to run the service (previews, galleries, your showcase).
• You represent that you have the rights to everything you upload and the right to sell it.
• Buyers receive a personal-use license to footage they purchase, unless the Media agrees otherwise.

6. Acceptable use

Don't use Gotchu to upload illegal content, infringe others' rights, harass anyone, attempt to break or overload the service, or misrepresent who you are. We may remove content or suspend accounts that violate these Terms.

7. Privacy

Your use of Gotchu is also governed by our Privacy Policy.

8. Disclaimers

The service is provided "as is," without warranties of any kind. We don't guarantee it will be uninterrupted or error-free, or that footage will always be available. Media are solely responsible for their own footage, pricing, delivery, and customer service.

9. Limitation of liability

To the fullest extent allowed by law, Gotchu isn't liable for indirect, incidental, or consequential damages, or for any dispute between a Media and a Buyer.

10. Termination

You can stop using Gotchu anytime. We may suspend or terminate accounts that violate these Terms or for other legitimate reasons. You can request deletion of your account by contacting us.

11. Changes

We may update these Terms; material changes are reflected by the "Last updated" date above. Continued use means you accept the updated Terms.
